How does California divide property in a divorce?
California is a community property state, which means assets and debts acquired during the marriage belong equally to both spouses and should be split 50/50 in a divorce. If you have specific property that you would prefer to keep, such as the family home, our attorneys can advocate for your interests and negotiate with your spouse on your behalf.
What happens if you die without an estate plan?
If you die without an estate plan in California, your assets will be distributed according to intestate succession laws, in which the court assigns someone to oversee your estate and determines who will receive your inheritance. This process can be lengthy, stressful, and expensive for your family members, which is why we always recommend planning early for what will happen to your property.
How is child custody determined in California?
California recognizes two types of custody: legal custody, which is who can make major decisions for the child, and physical custody, which is where the child lives. The court seeks to determine a custody arrangement that is in the best interests of the child, and both types of custody can be awarded to one or both parents.
How do you establish paternity in California?
